End User License Agreement (EULA)

Scope of the license
1. APPelit B.V. hereby grants to the legitimate acquirer of Studinty (“you”) a usage right for this App.
2. This license is personal. The App may be used only on the device onto which the App was downloaded and installed.
3. The purpose of the App is to provide a social networking service, while users are, of course, free to use Studinty for any purpose within the boundaries of these terms and conditions and the law.
4. It is not permitted to:
  - decompile or reverse engineer the source code of the App, except to the extent permitted by mandatory law or applicable open source license;
  - supply copies of the App to third parties;
  - sublicense the App or make the App available to third parties by rental, Software-as-a-Service constructs, or otherwise;
  - modify the App, except to the extent permitted by mandatory law;
  - remove or make unreadable notices of APPelit B.V. as the copyright holder of the App.
5. You may make a backup copy of the App. You may, however, not use the backup copy on its own or distribute the same other than in combination with the original App.
6. In addition to the terms and conditions of the present document, Apple’s Appstore may set terms for the acquisition and use of the App and related matters.
7. In addition to the terms and conditions of the present document, Google Play may set terms for the acquisition and use of the App and related matters.

Intellectual property
1. All rights to the App, accompanying documentation, and all modifications and extensions to it rest and remain with APPelit B.V. You only acquire those rights and permissions that follow this agreement or are granted separately in writing. You may not use, copy or publish the App except as permitted.
2. The App contains open-source software from third parties. Their respective rights holders grant you usage right under the applicable open-source licenses. These are included in the documentation. This end-user license agreement does not apply to this open-source software. Nothing in this end-user license agreement shall be construed as limiting or contradicting any right granted to you under an applicable open-source license.
Consideration
1. The usage right is granted at no charge.
Updates
1. APPelit B.V., from time to time, releases updates that may fix bugs or improve the functioning of the App.
2. Available updates shall be notified to you through notifications provided by Apple’s Appstore and Google Play, but your responsibility is to monitor these notifications. Updates are applied similarly through these platforms, which require an active internet connection.
3. Installing updates requires your separate consent. A proper application of updates requires the availability and good functioning of Apple’s Appstore, Google Play, over which APPelit B.V. has no control. APPelit B.V. is not responsible or liable for an incorrect execution of updates. No liability exists for any damage due to bugs fixed in an update you did not install.
4. An update can set terms additional to or different from the present document. You will be notified in advance and will be allowed to refuse such updates. Installing such an update constitutes your acceptance of the additional or different terms, which shall be incorporated into this agreement.
Personal data
1. The App processes your data. For more information, consult the privacy statement that can be found in the main menu of the App.
Support
1. You are solely responsible for installing and activating the App and the accompanying Web service.
2. You can provide feedback about the App via Apple’s Appstore, Google Play, or the in-app contact form, after which APPelit B.V. shall evaluate your feedback and contact you if necessary.
Guarantees and liability
1. APPelit B.V. guarantees it will use its best efforts to investigate any reported bugs as soon as is practical and to repair such a bug or create a workaround (APPelit B.V. may delay fixing bugs with the limited impact until the next planned update), but nothing else.
2. Except in cases of intentional misconduct or gross negligence or the violation of a warranty granted above APPelit B.V. is not liable towards you, regardless of ground, for any damages in connection with Studinty.
3. No liability exists in case damages were not reported timely (within 72 hours) after discovery to APPelit B.V. Also, no liability exists if the cause of damage is beyond the control of APPelit B.V. (force majeure). Excluded from liability are all handling and publications performed by users, such as creating adverts. The person handling or creating and posting the publications is responsible for any damage this causes. Studinty is merely a platform that brings supply and demand together; our responsibility is merely held to make this available.
4. The App communicates via the internet with a server under the control of APPelit B.V. to provide the complete service. APPelit B.V. uses its best efforts to have this server available at all times but makes no guarantees in this regard. APPelit B.V. can update the server from time to time, which may lead to temporary unavailability. APPelit B.V. will do its best to inform you in advance about unavailability. Everything in this document regarding updates, support, and liability applies equally to the server.
5. No liability exists for damages directly or indirectly resulting from the incorrect functioning of Apple’s Appstore.
6. No liability exists for damages directly or indirectly resulting from the incorrect functioning of Google Play.
Term of the agreement
1. This agreement enters into force when you use the App and remains in force until terminated.
2. You have the right to terminate your account at any time. This can be done in the app via the menu > settings or contact our support team for assistance. By terminating your account, you understand and agree that all associated data and content will be permanently removed from our systems. We recommend reviewing our Privacy Policy to understand how your personal information will be handled after account deletion. Please note that once your account is deleted, you will no longer have access to any information, content, or features associated with your account. Any rights or privileges granted to you under this Agreement will be terminated upon account deletion. We are not responsible for any loss of data or content resulting from the deletion of your account. It is your responsibility to back up any important information or content before initiating the account deletion process.If you have any questions or concerns regarding the account deletion process, please contact our support team for further assistance.
3. We may terminate or suspend your account without notice to you if we reasonably determine that:
  - You have breached any part of these Terms (including the User Rules);
  - Doing so would be in the best interests of our community;
  - We have stopped offering the Studinty services.
Miscellaneous terms
1. Dutch law applies to this end-user license agreement.
2. Unless dictated otherwise by mandatory law, all disputes arising in connection with this agreement shall be brought before the competent Dutch court for the principal place of business of APPelit B.V.
3. A finding that any particular provision of this agreement is legally void shall not affect the validity of the entire agreement. In such a case, the parties shall determine a replacement provision that is legally valid and approximates the intent of the offending provision as much as possible.
4. APPelit B.V. may assign its rights and obligations under this agreement to a third party that acquires the relevant business or copyright to Studinty from it.
User Rules
Studinty wants to create a global community that should develop a sense of belonging for its members. Everyone on Studinty should expect privacy and safety, so please respect the privacy and security of others. Users are responsible for their behavior, and they cannot hold APPelit B.V. responsible in any way. APPelit B.V. will do her best to keep the application and the users ‘’safe’’; if we find it necessary, we hold the right to take measures, as explained in article 8.3. If you come across any content on Studinty that you find objectionable, please don’t hesitate to reach out to us at info@studinty.com right away. Our team is ready to take necessary and appropriate actions against any user who posts objectionable content. There is a zero-tolerance policy for objectionable content and abusive users, and we will do our best to remove any such content within 24 hours.
1. Studinty is a place for creating community and belonging. Everyone has a right to use Studinty free of bullying, harassment, and threats of violence. Users that incite violence or that promote hate will be banned;
2. Post genuine content and do not cheat or engage in content manipulation;
3. Respect the privacy of others. Never post or threaten to post intimate or sexually-explicit media of someone;
4. Don’t impersonate an individual or an entity misleadingly or deceptively;
5. Keep it legal and avoid posting illegal content or soliciting or facilitating illegal or prohibited transactions.

We have a variety of ways of enforcing our rules, including, but not limited to:
