Terms and Conditions
The service “Studinty” is offered over the internet by the company APPelit B.V. The use of Studinty is subject to the below terms and conditions. Using Studinty constitutes acceptance of these terms and conditions.
Deviations from these terms and conditions are possible only by means of written confirmation by APPelit B.V.
Article 1 Use of the service
- The service Studinty allows you (but not limited) to publish a profile for yourself, participate in online discussions, create adverts for events/housing/marketplace, post messages, follow educational institutions and get in contact with other users. APPelit B.V. does not actively assist in doing so but does moderate to ensure the service is used appropriately.
- To use Studinty, you first need to register. After completing registration, you can directly log into your account and use the service.
- You must secure access to your account using the username and password against third parties. In particular, you must keep the password strictly confidential. APPelit B.V. may assume that all actions undertaken from your account after logging in with your username and password are authorized and supervised by you. This means you are liable for these actions unless and until you have notified APPelit B.V. that someone else knows your password.
- Studinty processes your data. You consent to all forms of processing within the scope of the service. Consult the privacy statement of APPelit B.V. for more information.
- Age Requirements. You may use Studinty and its services if you are at least 16 years old. By accessing or using Studinty, you represent and warrant that you are at least 16 years old.
- Permission by Parent or Guardian. If you are under 18 years old, you must have your parent’s or legal guardian’s permission to use Studinty and its services. We ask that your parent or legal guardian read this Agreement with you. By allowing your child to use the Service, you, as the parent or legal guardian, agree to be bound by the terms of this Agreement and assume responsibility for your child’s activities on Studinty.
Article 2 Terms of use
- It is not permitted to use Studinty for any purpose that violates Dutch or other applicable laws or regulations. This includes (among others) the storage or transmission of data using the service that is slanderous, libelous, or racist, or to create profiles on Studinty under the names of other people or pretending to be another person or a moderator/maintainer of Studinty.
- In addition, in Studinty, it is forbidden to:
- use indecent language;
- publish information where it is unwanted (offtopic);
- post information that is pornographic or erotic (even if legal under applicable law);
- publish information in violation of copyright or hyperlinks to such information;
- assist others in violating third-party rights, for example, by linking to hacking tools or tutorials for committing computer crimes that are clearly written to carry out criminal acts (and not to defend against them);
- violate the privacy of the third party, for example, by distributing their data without permission or clear need or the repeated harassment of third parties with unwanted communications;
- exercise commercial activities;
- and to do anything that violates applicable netiquette.
- Should APPelit B.V. discover that you violate any of the above, or receive a complaint alleging the same, then APPelit B.V. may intervene to end the violation.
- Suppose in the opinion of APPelit B.V. the continued functioning of the computer systems or network of APPelit B.V. or third parties is actually or under threat of being damaged or jeopardized, for example through excessive transmission of e-mail or other data, leaks of personal data or virus activity. In that case, APPelit B.V. may take all steps it deems reasonably necessary to end or avert such damage or jeopardy. APPelit B.V., in particular, is entitled to change your contributions at its discretion.
- APPelit B.V. is at all times entitled to file a criminal complaint for any offenses committed through or using the service. In addition, APPelit B.V. is entitled to supply your name, address, IP address, and other identifying data to a third party alleging that you violate its rights or these terms and conditions provided the validity of the complaint is apparent; no other way of obtaining this information exists. The third party has an evident interest in receiving this information.
- APPelit B.V. may recoup from you all damages it suffers due to your violation of these terms of use. You agree and hold harmless APPelit B.V. from all third-party claims arising from your violation of these terms of use.
- Your commitments to Studinty and our community. Who can use Studinty?Studinty is committed to maintaining a safe and accountable community. To achieve this, we require the following commitments from you:
- (a) Provide Accurate Information: You must provide accurate and up-to-date information about yourself when creating an account. It is essential that you use your real name that you use in everyday life.
- (b) One Account per User: You may only create and use one account for personal purposes. Sharing your password, granting access to your Studinty account to others, or transferring your account to anyone else without our permission is strictly prohibited.
- Your commitments to Studinty and our community. Restrictions on Use While we strive to make Studinty available to as many individuals as possible, certain restrictions apply. You may not use Studinty if:
- (a) You are under the age of 16.
- (b) You have been convicted as a sex offender.
- (c) Your account has been previously disabled due to a breach of our Terms, Community Standards, or other applicable terms and policies. If we disable your account for violation of our terms, you agree not to create another account without our permission. The granting of permission to create a new account is solely at our discretion and does not imply that the prior disciplinary action was unjustified.
- (d) You are prohibited by applicable laws from accessing our products, services, or software.
- User Responsibility
By using Studinty, you acknowledge and agree that:- (a) You will provide honest and accurate information to Studinty.
- (b) If you are under the age of 18, you have obtained the necessary permission from your parent or legal guardian to create an account or they have granted you permission.
- (c) You are solely responsible for all actions taken through your Studinty account, and any consequences resulting from the use of your account.
- (d) Studinty shall not be held responsible for any inaccuracies or misrepresentations in the information provided by users.
Article 3. Availability and maintenance
- APPelit B.V. uses its best efforts to have the service available at all times but makes no guarantees about uninterrupted availability.
- APPelit B.V. actively maintains Studinty. Maintenance can take place at any time, even if this may negatively impact the availability of the service. Maintenance is announced in advance whenever possible.
- APPelit B.V. may, from time to time, adapt Studinty. Your feedback and suggestions are welcome, but ultimately APPelit B.V. decides which adaptations to carry out (or not).
Article 4. Intellectual property
- The service Studinty, the accompanying software, and all information and images on the website are the intellectual property of APPelit B.V. None of these items may be copied or used without prior written permission of APPelit B.V., except and to the extent permitted by mandatory law.
- Information you store or process using the service remains your property (or the property of your suppliers or licensors). APPelit B.V. receives a limited license to use this information for the service.
- The license of the previous clause is for the duration of the (active) account.
- You may change or remove information you publish or store using the service at your discretion.
- Suppose you send information to APPelit B.V., for example a bug report or suggestion for improvement. In that case, you grant APPelit B.V. a perpetual and unlimited license to use this information for the service.
- APPelit B.V. shall refrain from accessing data you store or transfer using Studinty unless this is necessary for a good provision of the service (for example, by keeping statistics) or APPelit B.V. is forced to do so by law or order of a competent authority. In these cases, APPelit B.V. shall use its best efforts to limit access to the information as much as possible.
- Suppose APPelit B.V. discovers third parties, in combination with the contributions of others, have copied your contributions. In that case, APPelit B.V. is authorized to take legal action against such copying under its own or your name. APPelit B.V. must bear all costs, but you must offer your cooperation if necessary. This clause does not forbid you from publishing your contributions elsewhere but is aimed at allowing APPelit B.V. to act against copying of (substantially) all contributions to Studinty.
Article 5. Compensation for the service
- Studinty is made available to users at no cost for the purpose of registration and utilization of its in-app functionalities.
Article 6. Limitation of liability
- Studinty provides online services that allow users to post advertisements and other user-generated content. We are not responsible for the content of this user-generated content or the actions of the users who post it. We do not endorse any of the user-generated content posted on our platform nor guarantee the accuracy or truthfulness of any of the information contained in this content. We shall endeavor to prominently disclose any sponsored content to ensure that users are clearly informed that such content is paid for or otherwise compensated. As a user of Studinty, you are solely responsible for the user-generated content you post. You must ensure that the information you provide is accurate, lawful, and compliant with applicable laws and regulations. You are solely responsible for any losses, damages, or liabilities resulting from using your user-generated content, including any fraudulent or deceptive actions of third parties.Studinty is not liable for any losses, damages, or liabilities arising from our platform’s use or the content of any advertisements or user-generated content posted on our platform. We do not guarantee that our platform will be free from errors, defects, or interruptions. Our liability is limited to the app’s functioning as provided by us.By using Studinty, you agree to indemnify and hold us harmless from any claims, losses, damages, or liabilities arising from the content of your advertisements, user-generated content, or the use of our platform.
- APPelit B.V., in no event, is liable for indirect damages, consequential damages, lost profits, missed savings, or damages through business interruption.
- Damages may only be claimed if reported in writing to APPelit B.V. at most 48 hours after discovery.
- In case of force majeure, APPelit B.V. is never required to compensate damages suffered by you. Force majeure includes, among others, disruptions or unavailability of the internet, telecommunication infrastructure, power interruptions, riots, traffic jams, strikes, company disruptions, interruptions in supply, fires, and floods.
Article 7. Term and termination
- This agreement enters into force as soon as you use the service and remains in force until your account has been terminated.
- If you entered into this agreement as a user (consumer), you might terminate the agreement at any time.
- APPelit B.V. is entitled to terminate the agreement if you have not used the service in the last 18 months or have breached the User Rules as mentioned in our policies e.g. the EULA. If you haven’t used your account in the last 18 months APPelit B.V. shall first send a reminder mail to the e-mail address connected to your account.
Article 8. Changes to terms
- APPelit B.V. may change or add to these terms and conditions and any prices at any time.
- APPelit B.V. shall announce through the service changes or additions at least thirty days before they take effect.
- If you do not want to accept a change or addition, you can terminate the agreement until the date the changes take effect. Use of Studinty after the date of effect shall constitute your acceptance of the changed or added-to terms and conditions.
Article 9. Miscellaneous provisions
- Dutch law applies to this agreement.
- Except to the extent determined otherwise by applicable mandatory law, all disputes arising in connection with Studinty shall be brought before the competent Dutch court for the principal place of business of APPelit B.V.
- For any clause in these terms and conditions that demand that a statement must be done “in writing” to be legally valid, a statement by e-mail or communication through the Studinty service shall be sufficiently provided with sufficient certainty the authenticity of the sender can be established. The integrity of the statement should not be compromised.
- The version of any communication of information recorded by APPelit B.V. shall be deemed authentic unless you supply proof.
- If any part of these terms and conditions are declared legally invalid, this shall not affect the validity of the whole agreement. In such an event, the parties shall agree on one or more replacement provisions that approximate the original intent of the invalid provision(s) within the limits of the law.
- APPelit B.V. is entitled to transfer its rights and obligations under this agreement to a third party as part of an acquisition of Studinty or the associated business activities.
